Welcome to Bilingual America! By using our website, BilingualAmerica.com, or any of our related services, you agree to these Terms of Service (“Terms”). If you’re not comfortable with any part of this agreement, we kindly ask that you not use the platform. These Terms exist to create a clear, just, and respectful environment for your learning journey. We’re here to support your success, and this document helps ensure we can all move forward with clarity and mutual understanding.

1. Account Eligibility and Responsibility

You must be at least 18 years old to create an account with us. If you’re under 18, a parent or legal guardian must register for you and stay actively involved in your learning process. You’re responsible for keeping your account information secure and for all activities under your login. If you suspect unauthorized use of your account, please contact us right away.

2. Communications

When you enroll, you agree to receive essential communications from us by email. These may include reminders, updates, or important notices. We may also offer SMS notifications in the future, and you’ll be able to manage those preferences through your student portal.

We do not spam or sell your information. Our communications are designed to support your progress.

3. Profile Photos and Identity Transparency

To foster real connection in our learning community, all users are required to upload a clear and accurate photo of themselves. This helps us support you as a real person—not just a username. If you’re part of a corporate program, your profile and photo will be visible to your company’s assigned program administrators. If you choose to engage with other students, your photo builds trust and transparency. You can control your visibility settings at any time.

Regardless of privacy settings, your profile photo will always be visible to Bilingual America staff, including assigned coaches and corporate administrators. We believe in seeing each other as people, and this simple step helps make that possible.

4. Learning Outcomes and Expectations

We are fully committed to your success. Our programs are designed to help you communicate confidently and meaningfully in Spanish. That said, every learner is unique. Your results will depend on your commitment, consistency, and ability to learn. While many of our students reach powerful milestones, we do not guarantee specific outcomes such as native-level fluency or a particular score. We provide the tools—you bring the effort.

5. Virtual Tutoring, AI Tools, and Consent to Record

Our programs include virtual tutoring, AI-based tools, and voice recognition features. To improve the quality of your experience, we may record or monitor sessions that include audio, video, or text inputs. By using these features, you consent to the collection, storage, and analysis of these interactions for progress tracking, coaching, quality assurance, and support.

We partner with trusted platforms such as Microsoft Azure® and OpenAI®, in addition to our proprietary programming. While we strive for accuracy, AI tools may occasionally provide imperfect feedback. If you prefer not to be recorded or monitored, please avoid these features.

6. Acceptable Use

Please use our platform respectfully and responsibly. You agree not to:

  • Post content that is offensive, discriminatory, or unlawful.
  • Interfere with the platform’s operation or security.
  • Copy, share, or distribute any course content or recordings without written permission.

Let’s keep this a safe and positive space for all learners.

7. Community Participation and Peer Interactions

You may choose to participate in our private online learning community. This space celebrates growth, encourages insight-sharing, and supports respectful cultural exchange. By participating, you consent to the display of achievements like badges earned, course completions, and leaderboard highlights. These help foster motivation and connection. Visibility settings can be managed in your profile.

If you interact with others through messaging, study groups, or other means, you do so voluntarily. Bilingual America is not responsible for any personal or professional consequences of those interactions. We encourage you to fully vet any relationship before engaging personally. We reserve the right to remove users who engage in harmful or inappropriate behavior.

8. User-Generated Content

If you post comments or upload content to our site, you grant us permission to use, display, and share it within our community or marketing materials. You are responsible for ensuring your content complies with laws and respects the rights of others.

9. Intellectual Property

All course content, videos, tutor materials, AI-generated responses, and software on our platform are the property of Bilingual America. You may use them for your personal learning only. You may not copy, record, repost, or use any materials commercially without our written consent.

10. Cancellation, Subscription, and Refund Policy

You may cancel your subscription or course access at any time. Refunds are issued according to our published refund policy. If you ever have questions, we’re here to help. We may occasionally adjust pricing, features, or access with reasonable notice in order to improve your experience.

11. Disclaimers

We work hard to ensure a stable and effective learning environment, but no system is perfect. Our platform is provided “as is” and “as available.” We are not responsible for unexpected outages, technical issues, or outcomes resulting from decisions made using our content. If something isn’t working right, let us know. We’re here to help.

12. Limitation of Liability

To the extent permitted by law, Bilingual America is not liable for indirect, incidental, or consequential damages such as data loss, business disruptions, or reputational impact that may arise from use of our services.

13. Privacy and Data Security

14. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any legal matters related to this agreement will be handled under Georgia jurisdiction.

15. Dispute Resolution and Arbitration

If we ever reach a disagreement that we can’t resolve together, both you and Bilingual America agree to handle it through binding arbitration rather than court. Arbitration is typically faster and more cost-effective for everyone involved.

16. Changes to These Terms

We may update these Terms from time to time. If a significant change is made, we’ll notify you by email or on the platform. Your continued use of the service means you accept the updated Terms.

If you pause for more than three seconds your recording will be stopped so stay engaged. The conversation will include 10 interchanges, after which you will receive a feedback report for that session. You can have as many conversations as you like.

Grades are based on how well they say each sound and word (accuracy), how smoothly you speak (fluency), if they say all the required words (completeness), and how natural their rhythm and tone are (prosody). It reflects how closely they sound to a native speaker overall. To see a specific student´s score, click on the link that says, ¨view details for each student.¨

The fluency score shows how smoothly and naturally students speak. It measures their pacing—how often they pause, how long the pauses last, and how evenly their speech flows. Speaking too slowly, pausing too much, or sounding choppy will lower their score. Speaking with a steady rhythm and minimal awkward breaks will raise it. It’s not about speed—it’s about natural flow. To see a specific student´s score, click on the link that says, ¨view details for each student.¨

Spanish Power Course

Spanish Power is a comprehensive course that progresses from Basic to Expert levels, with 12 structured lessons in each level. The four levels are Basic, Intermediate, Advanced, and Expert. Each level builds step by step toward Spanish language mastery.

Depending on the learner’s goals, aptitude, and available time, a healthy pace ranges from two to six lessons per month. Each lesson takes the average learner about three hours to complete, with the option to invest additional time practicing with their virtual tutor.

Students can enhance their learning by practicing directly with our virtual tutors. While not human, these tutors are highly humanized and engaging. Voices are available in accents from Mexico and Costa Rica.

Practice sessions are designed to reinforce specific lesson content or focus on key subjects from the course, providing targeted and immersive Spanish language development. After each session, students can review all their answers and even grade their pronunciation using voice samples from their own responses, giving them valuable insight into their progress and areas for improvement.

Students can build real conversational confidence through our virtual tutoring conversation sessions. These interactive sessions simulate natural dialogue with humanized virtual tutors, allowing students to apply what they´ve learned in dynamic, real-time exchanges.

Conversations are guided by specific course themes and vocabulary, with voice options in accents from Mexico and Costa Rica. After each session, students receive specific feedback on their ability to comprehend and engage in the conversation, helping them improve fluency, listening skills, and spontaneous expression.

A score between 14 and 17 out of 20 earns a Movement Badge, indicating solid progress. Scores of 18 or 19 earn a Mastery Badge, reflecting a high level of understanding. A perfect score of 20 earns the Perfect Quiz Badge. All badges are dated and personalized with the student’s name for authentication and recognition of achievement.

A minimum score of 80 percent is required to pass, earn certification, and advance to the next level of instruction. Scores between 80 and 93 receive a Movement Badge. Scores above 94 are recognized as Mastery on the certificate and also earn a Mastery Badge. A perfect score of 100 percent earns a Perfect Exam Badge, along with special recognition printed on the certificate itself.

This section shows each student’s progression against their personalized goal over the last four weeks. When a student begins the course, they set a monthly lesson goal based on how many Spanish Power lessons they aim to complete each month. This metric tracks how closely their actual progress aligns with that goal.

For example, if a student sets a goal of completing 3 lessons per month and completes 2.8, they are 0.2 lessons behind their stated goal. If they complete 3.5, they are 0.5 lessons ahead of goal. This helps both students and coaches stay aligned with learning expectations and make timely adjustments when needed.

Session Settings Overview

Your session preferences let you customize how you interact with your tutor. The default setup is designed for smoother performance and faster feedback. By default, the tutor’s voice is muted to help sessions process more quickly, but you can enable it anytime if you prefer spoken feedback.

Your voice recordings are set by default for review before upload, allowing you to listen, confirm, and adjust your answer. When reviewing, the playback text appears in the box next to the microphone so you can easily check what you said. If you prefer a faster rhythm, you can switch to automatic upload so your response sends immediately. This option works best if you want to keep the session moving with more flow and interactivity.

You can also mute response sounds, keep the tutor’s feedback speed at a natural pace, and receive both coaching and scoring feedback. Scoring feedback explains where points were deducted and why, helping you improve with each exercise. If you skip scoring feedback during the session, you’ll still receive a summary report after all 10 exercises showing your scores for each one. These defaults create an efficient, focused, and flexible learning experience.

1. Voice-Only Experience: To build real fluency, all responses must be spoken out loud. This is a voice-only exercise; typing is not allowed.

2. Start Recording: Click the green button to begin speaking. When recording starts, the button will turn red and pulse so you know the system is listening.

3. Speak the Complete Sentence: Say the entire sentence clearly and confidently.

4. Stop Recording: When you finish speaking, click the red button to stop the recording. If you do not stop it manually, the recording will automatically stop after six seconds. Your answer will then upload automatically.

5. Review Answer Before Upload (Optional): Turn on the review toggle to see what the system captured. Click the upload button to the right to submit your answer. If you want to change your response, simply record again.

6. Coaching Hints: If your response needs a small correction, your coach will give a brief spoken observation and an on-screen hint. Pay attention to these cues; they will help you improve in the moment.

7. Three Attempts to Master: If the correct answer is not reached by the third attempt, a Go Deeper button will appear. Click it for focused feedback on your last attempt and the option to ask follow-up questions.

8. Session Summary: Complete all six exercises in a round to receive your performance summary, including feedback on pronunciation and fluency.

This is the number of students who are still enrolled in the program and presently paying. We are working to get them active, but as of this report date, they have not progressed in the Spanish Power course at least one lesson in the last four weeks.

Deactivated Students

These students have been deactivated from the program based on their request to retire from the program. They are no longer being billed. If they return back to the program in the future, they will need to resubscribe to the program.
